Dealer asking for more money
So I've waited for more or less about 4 months for my 228i. Now that the car is at the dealership, they are saying the price I was given when I signed the contract was inaccurate, because at that point of time(may-June) they've only just got the specs and rough pricing on the car. Now they are asking for $5k more before they can release the car to me. Anyone experience anything like this before ?

Did you order the car and have been waiting 4 months? Typically if you ordered the car the price is negotiated before the order is placed. I've seen the numbers skewed but not $5000 more. Something doesn't add up.

Unethical even if no contract- not sure about conversion of the Aussie dollar and if accounting on the contract was incorrectly totaled - but it certainly reads as if they're pulling a fast one.
Out of curiosity I would like to hear their explanation of the error / but probably wise to walk on the deal Last edited by overcoil; 10-07-2014 at 08:19 AM.. |

Hold fast & walk away if necessary. They might have another buyer for the car & will either clean out your pockets or sell in for more money than your contract price to someone else.
If BMW had upped the too dealer price they knew a while back & are now holding the car hostage.

If they cannot document a change in price from the time of order to sale, you should still have the remedy of cancelling the sale without penalty, or you could suggest to them that you meet in your equivalent of small claims court to enforce the original terms of sale. |

One of the many reasons why car dealerships should become a thing of the past (along with labor unions). You should be able to go in and settle on a price, place an order, and take delivery at the price agreed upon. To come back near / at delivery and say they under priced it is just wrong. It could be an honest mistake or intentional to get more money for the car, but either way they have an obligation to make good on the price. Either by giving you the agreed price or give you the difference in options (parts & service).
Tesla Motors business model is really threatening the whole industry here in the USA. Buying a car like buying a product off the shelve of a store; price marked is the price everyone pays. I know this is very anti-Republican and Socialism in nature, but being fair to everyone and not just to a same percentage of people is more ethical business practice. You should stand your ground on this and don't budge in the least. Knowing you could lose your car is what they are playing against you. Just realize it is not life and death and let them believe you will walk and do everything afterwards to let people know what happen to you with this dealership. Social media is a strong tool! Maybe you could have someone come with you to record your coming in to get the car and signing the papers. Tell them that you are so excited about taking delivery of your new car from them that you are recording the whole process to post on YouTube so the whole world can enjoy your experience. See if that doesn't send a message to the dealer since PR is a big tool for them. |

The first part sounds great, but not even a hint of Socialism here, as Tesla is privately owned...no government/"community" ownership/management in this business. Just a new version of distribution from private enterprise capitalism!

You went in 4 months ago agreed on a price put down a deposit and signed on it. If they missed something or made a mistake it's on them. Once you sign a contact they can't go back and add to it especially for $5,000 that's a lot of money. They should have been more aware of the price change before agreeing to it. I would go pick up your car pay what was the original amount and leave it at that. No way they can demand $5,000 for something you did not agree upon.

This is ridiculous and you should be insulted - you SIGNED their contract already. I agree with the above sentiment - go in and demand for $5,000 off for this.

So, I had a phone conversation with the rep today. Basically he's saying that the sales manager wouldn't sell me the car unless I pay the extra even though the miscalculation on the contract price was their fault.
Best he could do was give me back my initial deposit which I don't want. I negotiated a good price and I want my car at contract price that I've waited 4 months for. I'm not going to pay extra, just because you didn't do your job properly. It's not just the deposit, I'm already emotional invested in the car before I have it over the last 4 months. |

What does the paperwork say about the upfront price on the contract?
UK and Australian law are very closely linked and in my opinion if you thought you were paying a deposit to purchase a car at a contracted price AND that price was reasonable ( if the dealer had the decimal point in the wrong position would be a different matter) then the contract should be honoured. I've just had a 6 month old used Subaru "bought back" by the dealer with no arguments- I thought I was buying a low mileage used car and not a low mileage car that Subaru USA had used for US journalists to drive round the "closed roads" Isle of Man TT circuit. What the dealer did/didn't know had no relevance - the car was held out as a used car and therefore a reasonable person would not expect it to have been raced/rallied A quick search for Australian consumer law gives: http://www.australiancontractlaw.com/ http://www.fairtrading.nsw.gov.au/ft...contracts.page https://www.accc.gov.au/consumers/co...nto-a-contract And these consumer protection bodies: – Australian Capital Territory Office of Regulatory Services – Australian Competition and Consumer Commission – Australian Securities and Investments Commission – Consumer Affairs and Fair Trading Tasmania – Consumer Affairs Victoria – New South Wales Fair Trading – Northern Territory Consumer Affairs – Office of Consumer and Business Affairs South Australia – Queensland Office of Fair Trading – Western Australia Department of Commerce, Consumer Protection I'd just contact one of the above and ask "where do I stand on this?" |

Can you give us the name of the dealer and let them know the name of these forums (arguably the more popular 2 series/BMW forums on the internet).. and see how they feel about it. I am almost angry for you.
