Exhaust valve control issue

For some reason my exhaust valve stays open all the time. I used to have it set to "always open" in bm3 back when I was still using the stock muffler. I'm using a different muffler now and switched the valve back to "oem" in the tune and reflashed the car. The valve is still always open, ive tried this several times. I can open and close it using bimmerlink so I know the valve still works correctly but some kind of software issue is messing things up. Any ideas or other things to check?
