Repair estimate and DV claim?

Was at a stop sign waiting for cars to pass by when a woman in the intersection made a very quick left turn and slammed right into the middle of my vehicle. It happened so fast I didn't have time to put the car in reverse and back away. She most likely was on her phone texting or talking because she said she didn't see me parked there at the stop sign when she made the turn. From the accident, looks like she hit me around 25 mph?

She admitted fault and we have a police report to back it up. Waiting for her insurance to reach her and get her side of the story before they will proceed with the claim.

What is your best estimate on the repair cost? Vehicle drives fine, but parking sensors aren't working and looks like the radiator got pushed in. Hood, front bumper, both fenders, parking sensors, radiator and probably some more engine bay parts are damaged. Does it look like there is frame damage?

First major accident and still shaken up from it. Back and neck hurts a little. Could anyone give me any advice on how I should proceed and how to claim diminished value?

I was in a state of shock for awhile and kept replaying the accident in my head, but am able to decipher it better now.

Stopped at the stop sign. Looked right and saw the SUV moving fairly quickly, so thought she would go straight because her turn signals weren't on. Turned my head left for 2 to 3 seconds and didn't see any vehicles incoming. When I turned my head back to the right, the SUV was right in front of me and a second later she hit me.

My hand was on the steering wheel and foot on the brake pedal during the entire accident, which is evident because my vehicle barely budged after impact.

My right foot hurts, right knee makes popping/cracking noises when I extend it from a bend. Left wrist hurts, whole back hurts in random places and sometimes my left chest hurts from breathing. Neck is stiff and in pain.

I'm thinking to myself could this kind of accident really cause this much damage? The only solution I can think of is that my body absorbed the impact with the vehicle. It happened so fast I didn't even notice the whip lash after the accident. Is it possible the kinetic energy from the impact caused this much bodily damage?

Thinking about it further, I can't recall the actual impact. Right when I got hit, my mind must have blanked out for a few seconds from the whip lash? All I remember from before impact was, "please don't hit me and swerve out of the way" and next thing I know her vehicle is right next to mines. Is this common? To blank out during impact?


Last edit and update. Just did some research and it is common for people to not remember the whole accident. Now I'm worried I might have suffered some kind of brain damage.

From professional experience:
-yes, you certainly can sustain significant injuries in this type of crash, and often they don't show until several days after (you didn't develop the pain just by coincidence). Shock and adrenaline mask symptoms, and the swelling that causes pain takes time to develop. You should certainly have a full workup by someone who specializes in this (not a guy your insurance sends you to). Most of this will be temporary and trivial, but if it is something serious, you can do yourself harm by walking about on it.
-lack of recall for an event could be a sign of concussion, but it can also be something much less serious. Get this evaluated as well; if you develop new or serious symptoms (headache, balance issues, changes in vision or other senses, acting 'goofy/angry/etc.) then go to an emergency room immediately (have s/b else take you). Concussions can occur without loss of consciousness, and without direct blow to the head - it is your brain hitting the inside of the skull. But also remember that upwards of 75% of this type of concussion will recover fully.
-If I knew what city 'mars' is I'd be able to have a better idea of how available services are. Most larger cities will have specialists. Go for the best providers, better to look for those advertising various types of ortho/trauma work or affiliated with specialty hospitals, not just the 'hurt in a car? call me' types. And don't ask up front if they will fill out your paperwork, because many good docs will say 'no' - once they are treating you, most will do this, but they try to screen out those just looking for a 'disability slip'.
-Don't sign anything until you either have a month w/o symptoms, or get a full workup. The costs of rehabbing injuries could be 2-3x the cost of a car, even w/o concussion or fractures (you think the mechanics have a high hourly rate, wait till you get into this world).
-hope this all turns out to be unnecessary and you heal up fine, but better safe than sorry.

Obviously if you haven't seen a doctor see one right away. It does sound like you got a concussion.

On the diminished value claim, you need to get a diminished value report from a diminished value claim expert. They will state what the value of your car was before and after the accident. Usually you have to wait until after the repairs so they see what the condition is after the car is put back together.

The fact that you had your foot on the brake and the car wasn't able to move with the impact probably caused your body to absorb quite a bit of energy.

Only her car was rolling and your car acted like a wall to absorb the energy from the impact (granted, your crush zones helped as well).

There is another post on this forum with much more detailed info about pursuing a diminished claims process, worth doing a search for it, especially with them clearly at fault.

Looks like you're in the Houston area (713 area code in one of your photos). One of the best medical centers in the USA and plenty of highly-qualified doctors. Visit your personal physician and get a referral for a specialist, and don't put that off. Next, be sure you contact your insurance co. and provide them with the other driver's info and police report. They should be able to handle your claim for both your car's damage and your medical care and make sure you're properly compensated, plus they should be able to handle the diminished value claim as well. You can also retain an attorney if the other driver's insurance company isn't fully cooperating, but I'd reserve that until you have filed your claim and received an initial response.

See a Dr. immediately and don't settle until you see if you have any short term or long term injuries. If you do seek legal counsel. My wife was rear ended years ago and we did not settle until her injuries were diagnosed. She was fine but you never know. F---ing people texting and talking really piss me off.

Check the website of the local chapter of the BMW Car Club of America for shop recommendations. It does matter. Almost every reputable body shop will accept the insurance company’s repair estimates. If a shop won’t, I.e., they’ll charge you over and above the insurance claim, find another shop.

Thanks for all the advice. Wish I knew about BMW CCA before I dropped the vehicle off to the local BMW dealership for repairs.

They did an okay job, I guess. Paint is nearly perfect minus the curved edges of the fenders and hood. Found some over spray and they took care of it. Hood, fenders and bumper isn't aligned perfectly. Which causes some noticeable gaps.

Kind of strange, but the passenger headlight wasn't working after they installed a new one. They took it to the dealership and they said they replaced it with another new headlight under warranty. Picked up the vehicle today and guess what.....drum roll.....passenger headlight doesn't work.

Overall the vehicle was in the body shop for about a month and the insurance company estimated roughly $4,900 in repairs, but it ended up costing nearly $11,000.

Took the vehicle to a dealership for a trade in quote. It's a little more than I initially expected, but not as much as I would like. Put a deposit for my next vehicle and will probably have to wait anywhere from three to nine months. The GM told me there is eight people with deposits ahead of me.

The fun part starts later today when I contact insurance for the DV claim. Fairly certain it's going to be a ridiculously low amount and will take months of back and forth before they will settle on a fair rate. If worse comes to worse, I found a DV appraiser to use if they will take their quote. If all else fails, will have to take them to small claims court.

The second fun part is when I call the body shop and dealership to find out who will be responsible for the passenger headlight. The dealership doesn't have their own body shop. They have a joint body shop with Mercedes that repairs their vehicles and other high end vehicles.

It is amazing being able to drive this car again, but the damage from the accident is too much for me to keep the vehicle. It's never going to be the same and the dealership could have done a better job repairing it. The positive out of this is at least there are new headlights and a bumper/hood that doesn't have chip marks all over it.

Don't give up on the repair! I've run into this before. The first time after the shop would do nothing to correct their poor work, I wrote to the owner and received no response. I then wrote to the Chamber of Commerce and BBB. Within days I had a check in hand to have the repair done at another shop who made it all good.
The second time was a complete front end rebuild on my 2006 325i that cost 24k. That took about 4 weeks. Then it went back for another week to and from the shop and BMW for several items. After I paid and took delivery, I noticed direct sunlight the paint had a dark vertical area on both front doors. I took it back and asked the owner to come look at it in the sun light. He said, "that looks like shit" and repainted the whole car no questions asked. I continued to have some codes and the shop worked with BMW to get it all taken care of. It took some time but in the end it was perfect and I drove the car for 9 more years. I attempted to get DV on the second fix. But it was roadblock after roadblock. In the end my local agent was able to get me about 4k cash from the at-fault party's scumbag insurance company for some other things I never thought of. So I just banked that as my DV. Plus I kept the car so long that by the time I sold it, no one really cared about the accident. The at fault was a fight too. I never gave up that fight and finally got my 1K deductible back after about 9 months.
To sum up my points:
-Force the shop to make it right!
-Use all available means to include your insurance company and put the shop in a corner if you need to.
-Never give up
-Your car can be fixed as good as new and you will get over the accident.
-DV - depending on the state, it's really hard to get.
