Parking Lot Ding.
While in a mall parking lot Monday, I was stopped behind a Chevy when buddy in an Acura decides it's a good idea to back out of his parking spot into the passenger side of my M240.
Thanks buddy. Estimate to fix $3,648 (plus future diminished residual value)

You should see if a really good paintless "ding" removal person might be able to do. I rubbed the side of my rear wheel well against a pole but a paintless guy was able to buff out the paint scrapes and restore the damage to imperceptible. Took him about an hour of work but only cost me about $75.

Here in the UK we refer to a ding as the type of dent received from a supermarket shopping trolley.
That's one big trolley that's hit you. You have my sympathies. |

I would definitely have a top paintless dent removal place look at that, I had a lot worse on the hood and fender of my E46 that they restored to close to new (one small surface scratch they couldn’t fix). I actually fell off a ladder with two winter tyres and landed on the hood of the car. Some spots were several centimetres dented in. It did take 12hrs for them to fix (quoted 6hrs and only charged me for that), but I did retain the original paint and the cost was less than my insurance deductible.

Buddy was initially all bent out of shape and was pretty belligerent as in "What the hell, why didn't your Honk?", "Why didn't you move?", etc, etc, Things calmed down when I advised him that I had everything on my dashcam and that our Insurance companies would be able to handle it.

Depending on how insurance works in Ontario, I'd claim against his insurance and not get mine involved unless the other party's carrier isn't playing ball.
Since the other party is clearly 100% at fault, be sure you claim/sue for diminution of value. |

In your case, it is pretty "cut and dried" that you, being in the driving lane and behind another vehicle (unable to move), 100% of the blame should fall with the guy that hit you. Although, I wouldn't be surprised if the companies negotiate a 90%/10% split. It's stuff like this that makes owning and driving a nice car nerve wracking. |

Even South of the Border, not all states recognize diminished value in either insurance claims or in the courts. One less thing to worry about.
My own value diminishes daily and there is nothing I can do about it. |
