The MPE on the 240 doesn't have a exhaust valve

Correct. But you can leave it active and just locate it out of the way so it still functions (ergo not codes or faults) just does not operate any valve as stated, the M Performance does not have valves. I used the instructions for Dinan. This is exactly what I did when I put a non-valve Dinan on my 2018 330i.
