Just damaged both wheels and tires on a state highway driving 70mph, huge pot hole in the left lane. Who is paying for the damages? I assume 4 new tires and 2 new wheels.....

not sure if you're serious, doing 70 on the highway a pothole can definitely sneak up on you especially if cars in other lanes prevent you from swerving to avoid it.

I just feel a pot hole big enough to destroy two tires would have been noticeable well ahead of time unless you're tailgating someone or not paying attention.

Night time plus its a highway....cant expect a small crater in the middle of busy hway. Never happened to me in like 20 years

On a side note some fucking kid pissed me off on some old riced 335i, kept trying to race me in middle and left lanes, i switched to right lane because of him. Fuck face even gave me a finger.....I suppose because I didnt want to race....

I gotcha, night explains it all. That's unlucky. Most places have a place you can report pot holes but I don't know about compensating you for damages.

Will call state tomorrow. This is just ridiculous and extremely unsafe. They keep talking about safety and speeding and yet this happens...in general roads in Mass are on 3rd world country level

We are talking $550 minimum in damage here, easy $1000+, and even a few Gs if rims are bent

lol dont even ask.....yes but it was transferred and BMW lied about the whole transfer process in order to get new contract, so at this point I dont know if transfer was completed or not. Theyve been dragging this for a few months and warranty company said it must be done within 1 month.

By law highway division is not responsible for ANYTHING. BMW warranty was not transferred. Adviser said tires sold at dealership are not the same quality (even if same brand etc) as TireRack thats why price for 2 tires is almost $700 bucks. Active Steering alignment is another $300. Then pray to god if wheels are not bent or dont have to replace the other 2 tires to match

This varies by municipality, but in some areas, if the road defect was previously imported, the municipality is considered to have had "notice" and liability may attach. if you are the first to report, then this does not apply. It may be worth digging a bit deeper to see if this provision exists in your area.

Thanks, but knowing how states/governments work i have zero chances, especially when they state on their website that they are not responsible for ANYTHING.

Car at BMW dealer now. 2 wheels 2 tires + alignment are needed for sure, but since now I am going with my collision insurance I am hoping to get all 4 tires...makes no sense to replace 2 since the other 2 have 13k miles on them already and its a staggered set.

On the bright side, great service from dealer again. Gave me free loaner.

I wonder how does it work, towns/cities are responsible for car damage and state is not ? Its BS

It depends on which authority has jurisdiction over the road. Some may be state roads, some county, some city. I live on a city road, but the intersecting road at the first corner is a county road. The conditions of the two roads is quite different! Check to see who clears the snow, or if you call one division of government, they will be very quick to let you know if it belongs to another! Each part of government may have its own liability defined differently.

Oh, I know its state highway. If it was local town they might actually care. I have an app on phone which lets me report potholes etc to city, they fixed everything that I reported in 1 month and it was just road imperfections compare to hole I hit

I know for a fact that most Michigan township roads and highways are complete garbage and I have replaced a couple of tires and wheels for someone who, "didn't see it coming..." and was stranded..

On a slow day at work I tried getting after the local township, followed by the county government and state, all to be told, basically, "Go fuck yourself".

I gave up.. Much like most of the state has..

Sorry for your trouble, night driving is hard to see potholes. I had 2 ricers in a Mustang come up and play with me for a while. I nailed my 228ix and buried them. Got to 135 and backed off. Early morning no cars. This little sucker can fly.

So it would have been cheap to have tyre insurance. I have tyre insurance on both my BMW's

Insurance is insurance. Like most insurances, the company always wins. Not you.

Obviously something like medical insurance where your out of pocket costs can be in the millions it's smart to have it. However, for tires... eh... I'd do the gamble and drive as safely as I can.

That being said, night time driving is tough w/ potholes.

BMW tried to scam me with this insurance. The car already has/had tire insurance, previous owner needed to file transfer form but 2-3 BMW dealerships said its impossible and I must pay in full for new contract. A month down the road I found out that you can transfer it, but it was already too late maybe....I filed all necessary paper work and never heard back from tire insurance company

Everybody wants money, tries to scam you, fucks you over etc.....from people to big companies, can never get screwed only by an animal in todays world
