I'm sure they will be approved, the F30 3 series was already available in the US with darker tail lights with the Shadow Sport Line or whatever it was called. The darkness is very subtle, I once saw two F30s parked next to eachother and one had the darker tails and it's something you have to look for to notice but it is enough to make the car look that little bit more interesting and upscale somehow.
I believe the M3 CS also comes with the darker tail lights.
