Warranty lenience must be country specific, because in Europe an aftermarket cat/decat would void the warranty on the entire drivetrain. That would come directly from BMW Germany.
Talking down pipes, I don't agree with the less stress idea. The mapping by BMW includes wastegate control which assumes a level of exhaust back pressure (which in its own right is controlling boost). A free flowing down pipe means that the wastegate will no longer be quick enough to catch boost spikes. Boost spikes can kill an engine = a legitimate engineers reason to void a warranty due to engine failure.
Mapping companies that offer stage 2 tunes for catless DP (BM3, MHD,etc) will openly tell you they modified the WG control tables to avoid the added boost spikes.
In reality, you probably won't have a problem with a DP as the engine will 'endure', but there certainly is a valid reason to void your warranty by the dealer/ country network. Whether they choose to is in their hands.
