Yup: you were half right.
Thing is, 2-Series M Sport models get the higher 155MPH top speed limiter (not sure about the F30 or F32), so at least in 2015-think, the determinant is the OEM tires that your car comes with - NOT the actual speed capabilities of your M Sport build.
Personally I think it's crazy that the determinant is the one part of the car that's not warranted by BMW (and one that's easily and frequently upgradeable by the consumer), but what do I know? ...
