Had they paid the claim, I would have been responsible for the deductible ($1K) and then had to pursue the other parties insurance to recover my deductible amount. Further, had my insurance paid, I would have forfeited accident/claims free discount(s) and possibly had my rates increase. In the case of the total losses, in both cases we settled on a dollar amount which I was more than comfortable with, however it took a bit of negotiations to get there.

One other total loss we experienced involved out daughter who was at fault in my wife's car. However, because she wasn't the listed owner of the car (according to State Farm at the time) our deductible was waived - still haven't figured that one out, but didn't complain.

There is no doubt insurance is different in every country and every state.
I think where many of us, me included, are confused is the extra coverage for new car replacement. So say for example the car New is $50k and as-is used (before being smashed to hell) it's worth $30k. I get that at fault insurance would pay the $30k but where does the extra $20 come from? And does it count against you with your insurer?

I would understand if the policy was like 2 parts where the gap insurance made up the delta.

Dunno about the ROW, but in the Great White North (although not so much since we have global warming):
1. Your insurer picks up the "extra $20K tab" as per your contracted coverage.
2. No, it does not count against you

It's the law. Provincial Gov'ts can be and are tough on Insurance companies who screw around.

OK well that makes perfect sense. Too often in things like this what makes sense is often times not how things work.

With the insurance I have its no fault insurance so from what I understand I never have to deal with the other persons insurance and my insurance has to cover whatever cost because thats what I pay for in my policy.

I just spoke to my insurance they said the car is a total loss. Now im waiting on the offer they would make me. I'm not 100% sure how the new car replacements works but from what I read and what I was told I would get the value of a 2017 with the same equipment I had in my car + 5%.

http://www.icbc.com/autoplan/Pages/N...-coverage.aspx

Hopefully they get back to me before the weekend.

BTW, you do realize that you are under no obligation to replace it with the same newer model. You can buy anything you want or just pocket the cheque or buy a similar used one and pocket the diff.
I used my Subaru "replacement money" to buy a BMW X1..

Correcto, never have the deal with the other persons insurance. And depending on your insurer, they have to put you into a comparable vehicle one model year newer, and +5%. I assume the link you posted is accurate.

Also valid, I assume he was just asking for pricing purposes. (How much am I going to get? Sort of thing)

Good news on the payout, but why are you looking at ICBC information? That's for BC customers. You need to have a look at your own policy. It should outline what you are entitled to if you have new vehicle replacement coverage.

I do have new replacement on my insurance was just using that as an example because it seemed like a few people didn't understand how it worked and also new car replacement seems pretty much the same everywhere in Canada regardless of who you are insured with.

I am a salvage inspector in Michigan, and have seen less total out an M235i. Mainly because of the airbag deployment is what leads me to think this.

Nice, I did the same when I got totaled in my wife's subie. I think she appreciated the upgrade to the X1

Hopefully there will be a big enough payout for the pain and suffering (I've been though 2 major surgeries since the asshole ran into me and spent thousands in physio) that I can upgrade my car too, lol.

Just an update guys the car is totaled I received the check from the insurance company.

I went to test drive a few cars:

2018 RS3 - Even though it has 400HP I didnt notice it..something was missing for me
2018 Cla45 - Was really nice exhaust sound its nice!
2018 718 - The car had only 300hp but it was amazing, if i were to get it it would of been the 718 S but its to expensive for me right now it was $101k with the build I wanted.

So I ended up ordering a 2018 M240 my production starts this month

Congrats. Hope the wait isn't too long. Many of us have looked at similar options (TTS, 981 Boxster were on my list, among others) and found the total package the M235i / M240i deliver is pretty tough to beat for the money.

Yeah you checked all the right things. I would have subbed in a C43 coupe for the CLA even though it's bigger because I loathe the CLA with a passion, but would still have ended up right back with a 240.

+1 on the C43. Much better car all-around than the CLA. I would still go with the M240 though as well. The C63 AMG OTOH, but that's an extra $25k at least... The one car that I would take over the m240 if I wanted to spend an extra $10-15k would be the ATS-V coupe. Superb car all-around.

Yeah the price for the value compared to others is really hard to beat.

well I drove the C43 they didnt have the coupe at the dealer I went but the C43 seemed really big for me, I know the coupe is a bit different but should still be around the same size.

I honestly think the 718 S would of been the best of the cars if I was able to drive it because the regular 718 was really nice even with the lack of power compared to the others, but the price for the 718 S is really high lol, its basically the same price as a brand new M3 or M4 in Quebec.

M240 to me is the best performance / quality for the price plus LCI has a lot of little changes that I love, the new speedometer is so awesome

I think the C43 is the sweet spot, at least for the kind of driving I do. C63 too much car, too much money, that I would never get much incremental benefit from. If my commute was highway all day every day I'd get the C43, otherwise the BMW is the way to go.

Just for others looking the C43 has a TON of benefits over the CLA. Not FWD bullshit architecture, rear biased AWD, interior a TON nicer. And if you want 4 doors and can find a 2016 leftover 450 it's the exact same thing as the current C43 sedan.

The TT RS supposedly is faster than the RS3 I tried even though they're basically both the same engine in a fancy Golf.

Too expensive but still a nice car.

Enjoy the 2018!
