That'd be great. The majority seems to lean towards the car being totaled. And I assume you are too, considering the state of the vehicle and since you have vehicle replacement coverage. Might be the opportunity to get into a LCI model. Hope you're recovering well.

That car is totaled. Possible frame damage, damage on multiple panels, airbags deployed etc.. I would start looking for a replacement

Not quite sure why this matters to the rest of us. I mean, as a payer of insurance premiums, I would hope he gets less, rather than more, wouldn't I?

OP, I hope you opted for the new car depreciation coverage. If it is a total, at least they can't try to shortchange you on the value of the vehicle.

Ummm, no..
We should all hope that he gets what he's entitled to get based on the coverage he signed up for.
It would not be in anyone's interest for insurance companies to renege on contractual commitments.
I totaled (my fault) my 2 year old Subaru Forester back in early 2013 and Allstate gave me a cheque for the total amount I initially paid for the car along with all the other bills (incl medical, rental cars, all the other vehicles I damaged, etc) and were super nice to me throughout the entire process.
Best of all, my insurance rate (for the replacement X1) actually went down for the same level of coverage.

Guessing the insurer of the vehicle which hit the OP will be 100% on the hook for this one, so whatever type of coverage (new car replacement or not) he purchased won't factor in much, unless he files through his company, pays the deductible and they go to subrogation. At any rate, could get a bit messy before it's all worked out, especially with such a new vehicle. Best of luck to the OP.

Au contrare mon ami, it matters everything.
If he has the new the car replacement option on his policy, then that's what he's entitled to regardless of who is at fault. His contract is not with the insurer of the vehicle which hit him, it's with the the company to which he pays premiums - unless, of course, there is a specific clause which states that he's only covered when the accident is his fault.

As far as I know Quebec insurance is similar to no-fault states in the US (such as Michigan) - if you have collision coverage, your insurance pays you regardless of who is at fault. I don't believe your insurance company is able to recover this money from the at-fault party's insurance.

Ah that's right OP is a neighbor from the north. When I was in NYC for example and my T-Reg got t-boned by a cab running a stop sign my insurance paid me then they went after his insurance. Was not a total loss though (even with $30K in damage) so I have no experience with that and a new car reimbursement.

CAMOETO is correct.
In Ontario, my insurance company (Allstate) would cover me for all the benefits, including new car replacement, regardless of who is at fault. The cheque comes from Allstate (in my case). Let the big boys duke it behind the scenes as to how the costs are split.
That may not be the process in other jurisdictions. But regardless, I would think that even under the worst case scenario, the not-at-fault vehicle covered by new car replacement would still be entitled to the full amount even though his/her insurance company has to make up the difference.

That makes perfect sense - it was my understanding as well that all the fighting is handled by the insurance companies which is a good thing.

That has not been my experience. We have been hit a few times, twice totaled and once just needed repairs. In all instances, the at fault driver's insurance paid off all claims and my insurance (State Farm) was never involved. Had they paid the claim, I would have been responsible for the deductible ($1K) and then had to pursue the other parties insurance to recover my deductible amount. Further, had my insurance paid, I would have forfeited accident/claims free discount(s) and possibly had my rates increase. In the case of the total losses, in both cases we settled on a dollar amount which I was more than comfortable with, however it took a bit of negotiations to get there.

One other total loss we experienced involved out daughter who was at fault in my wife's car. However, because she wasn't the listed owner of the car (according to State Farm at the time) our deductible was waived - still haven't figured that one out, but didn't complain.

There is no doubt insurance is different in every country and every state.
