Takata airbag class action settlement notice
Got this post card in the mail today. When I checked my VIN on the http://www.AutoAirbagSettlement.com website, it said "Match Found."
However, when I went to the NHTSA website https://www.nhtsa.gov/recalls, it said 0 Recalls associated with my VIN. Not sure what to do, if anything?

I got the same postcard and the same message. Called my BMW dealer and asked about recall. They said there is no recall. I asked them to check if the car has Takata air bags.

I wonder how we would stand : We sold our 135 (bought an M235) very much due to the Takata situation. I wasn't willing to risk our safety, so we took the hit and moved on.

Transport Canada lists all years of all models of all manufacturers which have problematic Takata airbags and the 2-series is not listed. I'm betting the organization promoting the class action has cast a very wide net hoping to catch more Catostomus commersonii...

Strange, I put in the VIN for my 2015 X1 which got a match on the site provided, but then so did my 2017 m240i, which was built in 2017. Not so sure about this one...

yeah looks like the airbag site just acknowledges that a vehicle VIN is actually legit as opposed to it suffering from the Takata problem!

For what it's worth, BMW was very good about notifying me when my old E46 325i needed the airbags replaced. Assuming your vehicle is properly registered, you should have already been contacted by BMW if you had faulty airbags.
For each recall (initial recall was for passenger side airbag, second was for driver's) I got two letters in the mail. I'd already sold my car when the second recall took effect, but confirmed with new owner he also received the notice. Only annoyance for me was when the original notice stated that due to the huge recall volume, parts were back ordered by several months. So you were basically being given the wonderful choice of doing without your car or driving around with a faulty airbag. |

The post card refers to a class action suit settlement not a recall.I don't know if it's legitimate,you'd have to do more research to find out. I've gotten cards like that from law firms that I just ignored. They seemed like ambulance chasers.

Seems to be a mystery whether the US 2 series have Takata airbags. But as you say, even if they do they're apparently not using problematic bags.

My wife is smarter than all of us. I showed her the notices for both our cars and she pointed out that THIS IS NOT A RECALL NOTICE. It is a notice of a class action suit, which is a completely separate matter.
So we should all settle down and wait for the case to clear, after which we will probably get $5 each, if Takata can paid it, which I doubt. |

I got the same card. I've got a 2016 M235i.
There are three main potential issues, it seems to me, regarding the Takata airbag issue, as far as car owners are concerned: (1) personal safety, (2) inconvenience, and (3) monetary compensation. Apparently, the cards were sent out by an outfit called "Epiq Systems," a legal services firm. The 888 phone number puts you in touch with an Epiq Systems representative. When I called the number listed on the settlement postcard the person I spoke with said that the category of BMW 2 series cars *was* listed but the representative didn't seem very knowledgeable about the program and could not confirm whether or not my specific car was covered. I then checked the BMWUSA.COM/RECALL page and found that there are currently no recalls for my VIN code. I also called my dealer who told me my car had no recalls - apparently using the same BMW site. I also called BMWUSA and was told that my VIN code didn't produce a recall notice - he was probably using the same BMW page that I and the dealer were using. I asked whether any BMW's were affected by the Takata problem and was told that BMW cars in the 1, 3, and X series were affected. So right now I'm going on the assumption that these postcards needn't and shouldn't have been sent to 2-series owners. That said, I'll keep watching this thread to see if anything develops. Good luck getting an airbag if your car ever needs one. Just traded my 2007 335i because I could never get the recalled airbag. Even got a letter from BMW NA saying my airbag was "in stock". Apparently their idea of "in stock" was the manufacturer had some. Even threatened a law suit, contacted several gov't agencies to report BMW lying to customers and finally said "fuck it, its BMW's problem now and traded it for a new Toyota Tacoma. Have a friend that went through the exact same situation with their 335 convertible. Got the bs letter, contacted the dealer like the letter states and no airbag.

Well.
Two hours after I went to the settlement website, ads started appearing on my browser for - you guessed it - the website. Sure enough, two Google Analytics cookies (..._ga and ..._gid) were placed on my browser. I can only assume that these tracker cookies were placed there by the website. I removed them. |

I think BMW and other manufacturers caught up in this mess have been very opaque about which airbags they're putting in their new cars since the recall.
It could well be that the calculus was made to continue installing the faulty airbags, on the presumption that those airbags are minimally prone to failure in the earliest years. So, I wouldn't be surprised to see a very long tail on on this recall...

As a former original owner of a 2008 1-series and 2013 X1 (both affected by the Takata airbag fiasco) , I wonder who would be the beneficiary of a class action settlement? The original owner or the current owner?
BTW, my youngest son now owns the 1-series and my sister owns the X1. My oldest son (living stateside) just sold his 135i ragtop (he was the original purchaser) and had the Takata airbag replaced this year. So, who gets the cut of the jackpot?

I DK if it will work with BMW, but I got the airbag replaced on my previous car (Mazda 6) in preparation for trade/sale, mid-year 2015. I had not yet gotten the official 'repair-part-ready' notice and initially the desk person told me I just had to wait for that. I called back to service manager, explained that I had a medical concern (I would be particularly injured by a failure), so it was not just a routine recall, and they replaced it w/i the week. I think that the dealers have a limited number of these to use for accident repair, separate from the stock for recall.

One additional issue, I forget the exact particulars but there can be issues for lease turn in / buy out. First on turn in BMW dumped the pull ahead program for cars impacted by the airbags so they could delay dealing with all this crap they couldn't resell immediately. Then I could be wrong but I think there was some issue around buying out your lease.
None of that may apply anymore assuming they have adequate stock of replacements but something to look into.
