Special Order Arriving but Can't Buy Now - Any Takers

I ordered a 230i RWD from Passport BMW in MD in December. I got a great price for my build (Alpine White, Oyster Sensatec, Driver Assistance, power seats, moonroof, H/K) of 37.5k. However, it looks like I need to move back to California in the next couple of months for family reasons. I won't have the time to drive the car across the country and am not sure I want to spend the money to ship it (and take on the risk of something damaging the car in the process).

If anyone is interested, please comment or PM me. I paid a 1000 deposit that they said is nonrefundable. If someone wants to take delivery in my stead, maybe I can get that back.

Just an FYI, the deposit is always refundable. By law, they cannot take that. So do not walk away without that money.

That's simply a dick move on their part. They could very easily put the car on the lot and sell it that's a relatively "normal" build. Who were you dealing with over there?

No sure where you heard that. I used to have a dealership and we never refunded NONE-REFUNDABLE deposits.

What they say is of little consequence regarding your actual liability. Read the contract you signed. There will be remedies for breach, probably on the back in smaller and lighter color print (hard to read). Unless Maryland has consumer protection statutes which override a contractual agreement about deposit refundability, the written deal controls the outcome, unless they suddenly want to be "nice" about it.

I signed a print out PDF. There was a space that said "Non refundable deposit-special order." No fine print and no back of the page, does this control?

If you signed their document, and there are no statutes making such terms illegal in Maryland, then, yes, that controls. You can write a contract with a crayon and a tissue. Parties may agree to almost any terms, as long as they are not illegal nor found to conflict with public policy nor be considered unconscionable. I suspect your deposit is theirs. Are you sure you don't want to ship it? It just took a long truck/boat/truck ride to reach the dealer already!

If the car hasn't left factory yet you MAY be able to just do a PCD in California instead. PCD is easier than having it delviered to a different dealer.

This is a wonderful idea , and may even be actionable as late as before leaving the port! I'd jump on this as a first choice solution, and the dealer may be willing to step up to help, considering the situation.

Yeah they still get credit for the sale, don't have to worry about dealing with shipping or involving another dealer to prep (fee is like $500 I think). Worst case your car would get stuck in port in EU for a few weeks extra while arranging the change.

They have to give you your money back. Tell them if they don't give you the deposit back you will get your attorney. They are being fuck heads don't let them get away with it. Grow a set!

Thats just what my dealer in IL told me. The SA said the deposit was non-refundable but then pulled me aside saying that they actually couldn't do that.

It turns out that I will get a relocation stipend through my firm, which changed the numbers a fair amount. So, I think I'll be picking up the car here, since I won't be moving for three months, and shipping it when the time comes.

Suggest using an enclosed carrier. At the OEM where I worked, we used:

for shipping show cars and market research vehicles from Michigan to the coasts, etc.

Thanks for the recommendation! I'm definitely going to splurge (/bill) for an enclosed carrier, but there are so many out there that it's hard to know who's good.

These 'carriers' are all brokers. Yes, some are more careful in screening their contractors, but in the end it is the guy who actually hauls the vehicle who is responsible and you have no way of knowing who that will be.
That said, when I shipped our lease-buy-out CRV to our daughter in Indiana a year ago, the guy was superb and dropped it off right in her driveway, though he didn't have to. But he was a Syrian immigrant, so we won't see the likes of him again.
