I would say No. Seriously, if that is a brand new tire take it back to them ASAP and have them replace it. That looks pretty deep.

I would seriously consider not going back to Pep Boys try pricing a new tires on TireRack and having a dealer install it. And recuperate the monetary loss by working more and spending less over the next month.

Not only would I never go back there, I'd have a real tire shop check the balance on the others (and look them over real good, especially on the inside edge where it is hard to see). They must have been in super-slop mode, so no reason to expect they took any care w/ anything else, probably just left the old weights where they were.

Make them order it and pay for a loaner. Everyone makes mistakes. I hate when people try to cover up their f*ckup. Good luck OP.

Are you saying they installed a new tire with a gouge out of it? What are you saying?

Are you saying it shipped like that from Tire Rack, with the gouge in it? Or Pep Boys put the gouge in it while mounting it? Or you don't know?

Contact Tire Rack and email them pictures of the tire. It may be difficult to explain to them why you had a ripped tire mounted rather than RMA'd. It should have been identified at the time you received it and returned.

Now, they (Tire Rack) can say Pep Boys damaged the tire during install.

I don't know much about how Pep Boys mounted it and w/ what machines they used. But logically, this tire should not have passed inspection at the manufacturer. Generally, tires are pulled for cosmetic blemishes and sold at discount. A damaged tire like yours would have been pulled and recycled.

Damage like that looks like a bad install or it was mishandled during shipment and someone used a sharp tool to remove the tire-wrap/packaging.

Trying to affix blame is going to be difficult, since you say it came from Tire Rack that way. So Pep Boys is off the hook and Tire Rack will question why you had a damaged tire mounted and not returned.

Good luck, but guessing you'll be buying a new tire unless Tire Rack feels extremely generous.

As I have said many times on this forum, find an independent shop you trust. I always buy tires from TR, have them shipped to my local independent, and have them do the install. Never a problem.

This is all confusing. You don't know if it came from Tire Rack that way. You don't know if Pepboys damaged it. For all practical purposes, since you did drive it, you could have done it. But, does it really matter? I thought if you buy tires/wheelsets from Tire Rack they come with roadhazard warranty, so Tire rack should honor that warranty.

I drove it 1 miles home and noticed it, it didn't happen with me, I've learned that this pepboys is run by amateurs I literlly has to give them written instructions on wht I needed done because last time they tried putting the wrong rim on the wrong tire and forgot to take the spacers off
I ended up buying another tire from tire rack that will be here Tuesday now I just needs to find a new place to install

Then I'm going to bmw to make sure they didn't mess anything up

Take it back and have it replaced, there is a chance that it was trapped air between the sidewall and the ply, though that should have been captured by the xray.

Trapped air = scrap tyre.

The key to learning from a mistake is to not keep making it over and over hoping it will turn out differently.
