Fender bender.Grrr....

Damn. Got into a little fender bender. Was pulling out when parked on a commercial street and did not see this guy creeping up behind another car and my front bumper hit the side of his car. Not much damage but the bastard got out, flipped out and started kicking. Broke my headlight and put a dent in my front wheel side panel. Bastard! Completely my fault but man, the guy had a shitty car and did a lot of damage with his foot. If I was still young enough with nothing to lose I swear I would have kicked the living daylights out of this punk.

Any idea on the costs for a front headlight, bumper replacement (don't think there's any damage to the diffusers and electronics, just cosmetics) and a front side wing panel?

It really does not look that bad but with BMW I'm expecting 5-10k.

Thoughts?

Man, that really sucks. Accidents are accidents, but that jerk intentionally damaged your car. He should be held responsible for some of the damage, not to mention reported to the police. This world is not short of imbeciles.

I'm in Toronto. According to my insurance company, it is part of the same incident and since I am at fault for the initial impact they treat it as the same accident. I agree that if I pursued this guy, reported it to the police and jumped through oops he would certainly have to cough up some $ but I hate to say it's not worth my time. Talk to the head honcho at your insurance company. I think you got bad advice.

Biggest issue is how long you will be without your car. My accident was June 30th....finally getting car back next week. BMW did not get them parts until August 18th.

I assume you have his license plate or contact info? I'd speak with your attorney at least in the US that's not part of the accident. Since he left his vehicle and violently attacked yours, here at least that would be considered some form of assault and battery. Not for the damage, if you weren't in the car it would be different. But since you were there while this is happening, even though you may not have been fearful of bodily harm many people would have been and that's how the laws are written. Had the same thing happened to your wife or daughter for instance it's perfectly reasonable to assume they'd be scared out of their minds that some maniac was going to hurt them. That's at least how it would work here.

My dealer recommended one. It's a good one, great reviews. Sine I am leasing I will go that route. This way they will not have an issue with the repair once I turn the car back in.

Sorry to hear. Guy shouldn't have made it worse by beating up your car, but good on you for not escalating it more. I don't understand how the insurance company can consider his extra damage to your car as part of the same accident, because if he didn't do any of that they would only be paying out to fix a bumper. Now they'll have to pay to fix a bumper, headlight, and quarter panel.

Do you have a picture of the damage? If the dent isn't bad, it might be fixable with paintless dent repair.

Oooh, sorry to hear about the predicament. Kudos for keeping an even keel in I'm sure a very high stress situation.

As others have mentioned above, I'd assume he would be at fault for the damage done to your car AFTER the initial accident (vehicle to vehicle). Hope everything works out for you in the end

Damn, sorry to hear about that but Toronto is dangerous for driving. Always and always get a dash camera, when he does that you should film it and with some nice video editing you can blame everything on him.

Wow thats messed up, like others I commend the OP for showing a lot of restraint at a time that many of us would have lost it. I'd like to think I wouldn't have just ran the dude over.

Thanks for the support guys!

Looks like the the total damage is around 4800 CAN$.
Half of that is the left headlight (1200$ FFS!!!) and the bumper 900$.
Plus some minor parts, body work on the right wing and hood which as also damaged a little bit.

For those interested parts will be ~3 weeks away. They have to come from Germany, no stock in NA apparently.

The good news is the car is fully drivable.

Also good news is that even though the insurance company lent me an X3 it was great to be back in the 235i after the appraisal! Even with a few dents!

Not sure about that....the body shop I went to was at the epicentre of Ford Nation in RExdale and I live downtown. Some real nutjobs on the DVP/401. I spent 3 hours in traffic today!

OP im in toronto too, pm me or post the guys licence plate with colour and model (so that I can stay far away from him ). Also, I am going to tell you harshly that not having a dashcam in Toronto is pure stupidity. Mine cost $100 and saved my ass atleast once. I just bought one for all my family and friends this year. PM me if you need info about where to get a decent dash cam.
