My M235i got smashed in the parking lot..proof driver aids don't help idiots
I was leaving a local mini golf place with some friends and as I was driving through the lot a 2015 Explorer punched it in reverse out of its parking spot and rammed into the side of my M235i. Thankfully everyone was fine but I am super pissed. The female driver and her husband were reportedly arguing over him leaving his "money clip" somewhere which apparently led to her backing out at a fast clip. I tried to swerve left to avoid her but she was coming too fast.
The offending vehicle: Has anyone had any success getting diminished value for a car after a crash? |

Since it wasn't your fault and it is becoming more common I think you are probably going to be successful. Work through your insurance company and be polite but insistent. You lost at leadt $500-$1000 of value because the repair will show up as a major incident.

Oh you will lose more than $500-$1000. I was successful in getting Diminished Value. It is a long process but worth it. First thing you should do is hire a DV appraiser company. They will come do a pre-inspection of the damages and then come out to inspect the repairs afterwards. They will then write up a report and demand letter for you to submit to the other drivers insurance company since it was 100% her fault. They will probably come back with a low ball offer which you should not take. What you do accept should be close to what the appraiser says the loss in value is. I was rear ended and had over $11000 in damages. The at fault drivers insurance company paid the body shop to fix my car and rented me a MB C250 for the 2.5 months it took to get it repaired. Once it was all repaired and I submitted the demand letter for DV, it took another 2 or 3 months to get my check from the insurance company. They are not speedy when handing out these checks. Their initial offer was $2500. I instantly refused that offer. The insurance company then sent out their own third party appraiser to see what he came back with. Well he must have been close to my appraiser because within a week of him coming out, they called and offered me $7000, which is what my demand letter asked for.

Laws differ by state on the requirement for insurance companies to pay diminished value $$$. Some states don't require it at all, so check with your state to see if you have that option.

So I got off the phone with the insurance adjuster for the other driver (they have State Farm). They are claiming they pulled out from their parked position, stopped in the lane of travel, were at a complete stop and I ran into them as they were stopped. The adjuster for State Farm even said "the physics of that don't make sense.
I am furious but I guess I should know better than to expect people to be decent. |

Front and Rear, wide angle. While it may not have caught the idiot backing up into the OP, it would have caught where the idiots car was before and after the accident, in addition to capturing all the sounds and people speaking (Yes it is a sensitive mic). This should be enough to prove that the person was lying.

First of all, I'm very sorry for the OP's incident and wish him all the luck in recovering - both financially and in terms of his car being repaired perfectly. Not to steal the thread, but would like to share with a similar experience with my previous BMW (the 528xi); I was in the line to the gas pump when a young women behind the wheel of an old Renault Laguna, standing directly before me in the line, suddenly decided to resign from waiting - all I saw were her reverse lights and she backed straight into my car!
Two points to be made: - the world is full of people who should never had gotten their driving license - the BMW claims about the F10 front bumper being able to withstand an impact "of up to 7 km/h hitting a concrete wall" proved to be true, as - believe or not - I didn't have a single scratch on my car. Really, just couldn't believe my eyes - she really backed away fast, and the impact was considerable - and yet not a single trace!
