What does the manual prove? That's kind of vague. At the force the rollbars deploy at I hardly doubt that the headrest in the down position will stop them from fully deploying.
Furthermore I went to BMW of Sherman Oaks and the technicians looked and said they don't see any problem. Just make sure if you have rear passengers to put the headrest in the up position.
Anyway, respectfully I grow tired of this debate. If you do not want to modify your headrest than it's simple, don't!
