Speeding Ticket
Got hit with a speeding ticket in NYC today. 60 in a 35... Any tips or suggestions on how to fight it? Any suggestions would be greatly appreciated!
Having never fought a speeding ticket before especially in NYC not even 100% sure how the procedure works. I heard you stand before a DMV tribunal of sorts not even a court. |

Can't speak on whether to hire a lawyer or not. My experience in heavily populated N.J. was that at the busy courthouse a bailiff approached me and other speeders in the hallway before judge entered courtroom and offered to reduce (speeding passing on shoulder ) to: no points, court cost and a probationary period)
So there is always hope that kind of penalty will be levied. |

That's going to hurt. Never fought a ticket before, but I think this might be a good time to try. Worst I got was 55 in a 35 in VA, and that was almost enough to go to jail (I hate VA...)

Not sure if this is still the case in New York, but there used to be a box on the back of the ticket where you can submit a plea of not-guilty and request a supporting deposition from the officer. 90% of the time, you don't get this document before your court date.
Many years back I got nailed. I was totally guilty, going 85 in a 65 as were two of my other friends driving behind me. The trooper pulled us all over at once. We all requested supporting depositions and did not receive them. When we got to our court date, we gave the clerk a motion to dismiss on the grounds that we did not receive our depositions. The judge looked at this and gave us two options. Option 1: He dismisses the case without prejudice at which point the officer is free to reprosecute and get us our depositions on time. OR, Option 2: Plead guilt to an 1110A which is failure to yield to a traffic control device for no points. We took option 2.

Thanks, yeah might look into hiring a lawyer since after looking into it, You go speak to a DMV arbitrator of sorts and they're not the most neutral party. 35 shouldn't even be a speed limit imo....

Yes Virginia do not play! They were hit pretty hard in the recession and that state turned ticket writing into an industry

Except in residential neighborhoods. They tend to put them in areas around here that have allot of businesses. Even if they are on large heavily traveled roads. Basically if there is a center turn lane to turn into a businesses, that stretch of road will go down to 35. I can see the reasoning because folks turning from a center lane often misjudge the speed of oncoming traffic. The higher the speed the harder it is to judge. It is frustrating when you are just driving down the road with light traffic and feel you have to practically coast through these areas.

Ouch. I'd lawyer up but it also depends on if this will affect you insurance. Often 1 ticket on your record is considered a freebie. Here in Seattle I can hire a specific lawyer for $300 and almost guarantee to have a speeding ticket thrown out.

Yes, I had a situation on a motorcycle accident I had back in 2010. Even though it just involved me and the ground, I was still given a ticket for failure to maintain control of my vehicle. I hired a lawyer at a similar fee to get it thrown out so it would not effect my insurance. The bike was totaled and have not set foot on a motorcycle since...so in hindsight I guess it really did not matter. I did not know that at the time though

So ah, were you actually going 60 in a 35 zone? Or, is that just the officer's opinion.

Why is that your opinion? Using an online calculator, the average stopping distance at 35mph is 58 feet. What is reasonable for you in a residential area where kids do unpredictable things?

VA is the worst. I got a ticket for having a radar detector there. Was going to Reagan airport and didn't even know I crossed into VA and he was waiting with his radar detector detector.

It's not even the ticket it's more so the baggage that comes with the ticket. Plus not to get on my soap box but think of all the incorrect tickets issued that don't get dismissed. I'd like to think by fighting all tickets it evens things out. I wouldn't be too heart broken if I lost admittedly but I rather at least make sure I could use the system in place to my advantage to whatever extent possible.

Those are the worst kind of highways.. Especially the ones that have speed limits that go from 55 to 65 to 45 to 35..
