Rear end accident advice - not at fault rental car

I was stopped at a local road train traffic when some kid in a Jeep Grand Cherokee hit me from behind. It's been a long time since I've been in any sort of car accident so if felt pretty hard but apparently he just let his foot off the brake and rolled into me. My son was in the back in his booster seat so luckily it was nothing serious.

It's obvious that it's the other guys fault and the police report states that. Other driver was very apologetic since my kid was in the car.

Police officer asked me if I really wanted to get a report done since damage looked to be under $500.. I said no way that's under $500. (Got an estimate done right after and quoted $2500)

Anyway my question is since the other guys insurance (progressive) should be paying for my rental for about a week, how is this usually handled? My car is an m240i convertible. What would be considered comparable?

Comparable, for a rental from the other person's insurance? Good luck!

When someone hit my 2015 335xi I was stuck in a base Elantra for a month. It was terrible. You can raise a stink but if you want something better you'll need a lawyer or your insurance to get involved.

An AMG C43 Cabriolet would be comparable - maybe even a step up, but not a big one.

It's only a week. Take what they offer. I hope you and your son are ok. My wife was rear ended years ago and after 2-3 days she experienced neck and back pain. She got treatment and was ok. The person who hit her's insurance paid the medical bills. Make sure you are not experiencing any after effects before you settle.

The other persons insurance company will accept fault and pay for your rental. They will have a certain allotment per day to be payed out for the rental. If your policy has more of a rental allotment you may be able to get into something nicer.

Like why was mentioned above, you'll probably be in a little crapper of a car. I had a Sentra when my car was at the shop.

Ask for a Huayra and aim for an Alpina.

Not many insurance companies will put you in an equal value vehicle. If you drive a 3 series BMW/Benz, expect a Mazda 3, and so on, lol. That is unless you make a claim through your insurance, provided you pay for the additional accident/rental coverage on your own plan..

When I got rearended in my F32 the other party had Mercury insurance. I had a 2017 Nissan 370Z from enterprise for 2 weeks, it was awesome!

Naw, no way. I considered swapping our M235xi ragtop last year for a new MB C43 AMG and during the test run, my wife and I were hugely disappointed in the ride and handling, so that would be a step down.

So my insurer Geico is asking if I want to file the claim through them, pay the deductable and get rental which they will in turn go after the other guys insurance for reimbursement since I was not at fault.

Or I can go through the other guys insurance myself.

Thoughts? Will my premium go up if I go through my own insurance?

Dunno why you would have to pay anything, including deductible if you let your insurance handle it for an accident which is not your fault.
My Z4 was rear ended in 2005 causing $15K damage to front and rear (as I was pile driven into a truck in front of me.
Allstate handled everything including the rental for 6 weeks while my car was being repaired and Allstate had to fight the other guys insurance company as to whether some parts needed to be repaired or replaced and coverage of rental car for extended period..
You don't want to fight the other guys insurance company over potential repair disputes which could arise.
Get your Insurance handle it - that's what they're there for, but that shouldn't cost you anything.
And NO, your premiums should not go up when it's the other guys fault.

The other driver is at-fault with a ticket issued. Under mini-tort (if your state proceeds that way), you should pay nothing up front. Geico should directly cover you with no premium increase and recover the deductible from the other guy's insurance company.

I'd go with the other guy's insurance. It may be a bit more of a hassle, but I wouldn't want to foot the bill on the deductible. Chances are even if you go through your insurance, since the other party is at fault they will subrogate the claim and recover your deductible, but it could take a while. I wouldn't worry about what type of rental car. I know it wasn't your fault, but trying to get a comparable care seems pretty petty to me. As someone else said, driving the rental makes you appreciate your car even more. Good luck on getting a quality and quick fix to your car. Also glad no one was seriously hurt.

I would go through their insurance. I mean its really not that big of a deal to have a comparable car. It makes it easier overall. But the only time i suggest going through your insurance first, is if the other party is being difficult. If they are being upfront and things are moving smoothly, just deal with the crappier rental for a bit. But just FYI i had very minor front bumper damage visible that turned into 7k after an initial estimate of 1800.

I agree. Lady rear ended me last year, and was trying to blame me. So I had to go through my insurance and pay the deductible, rental car through my insurance, etc. Then it was several months before my insurance company got everything settled and forced their insurance to pay, and paid me back the deductible.

So if their insurance is doing the right thing just go through them.

Any claim involving your insurance will show up on your record, one way or another. Goes with the other person's all the way.
As for the rental, you takes what you gets. I have never heard of 'comparable' rentals.
Last year, though, when someone backed into my parked 235, I got a Mini convertible for a week, because that is what Enterprise had, that or a pick-up. It was early September, perfect ragtop weather.

Never gotten a comparable rental despite trying. My local enterprise was happy to work with me however. Took what they had initially. Then they said call us tomorrow and I think we'll have something else. They hooked me up with something better. Dad and daughter have done the same.
I have to get my rear bumper repainted. I was told 3 full days.
