I bet it is totaled.
MY first E92 was damaged in a similar way in Feb 2007 (day after the Colts won the super bowl, some drunk idiot T-boned me).
One of the factors that led to the decision to total the car was that it was only 3 months old (the E92 itself, as I had the first one in Indiana) and parts were not going to arrive in a very timely manner.
Also bent the frame a very small amount, and BMW would not re-certify the car. And then that was that.
Worked out ok for me, since there weren't any Blue-Book figures out yet, all they could deduct for was mileage.
Hope the owner of this car gets a similar deal...
